Example Harassment Cease & Desist

The following is an example cease and desist letter for harassment. This cease and desist template should not be used without first consulting with an experienced attorney.

People using this form should edit out the brackets [ ] and fill in the appropriate information that is applicable to themselves.

Also, anyone using this will want to be as detailed as possible when naming specific instances of unwanted behavior.

Read over this form carefully before sending it out in order to make sure that all of the information you have supplied is accurate.

When you send this letter to the perpetrator, allow 15 days for a response. This gives the perpetrator time to receive the letter (the mail can be slow sometimes), read it over, examine his/her own legal rights, and mail it back (allowing time for the letter to slowly move through the mail on the return trip).

Make sure that the perpetrator’s activities actually fall outside the scope of his/her legal rights. Remember, people sometimes do annoying or creepy things, but those things are not always illegal. If someone is acting an a way that is still bothersome to you but those activities do not necessarily fall within the definition of stalking or harassment,this may not be the appropriate remedy and you may need to pursue a different course of action.

Dear [Perpetrator]:

This CEASE AND DESIST ORDER is to inform you that your persistent actions including but not limited to [insert actions here (example: calling me in the middle of the night and hanging up, waiting outside my house, etc)] have become unbearable. You are ORDERED TO STOP such activities immediately as they are being done in violation of the law.

I have the right to remain free from these activities as they constitute [harassment/stalking/etc.], and I will pursue any legal remedies available to me against you if these activities continue. These remedies include but are not limited to: contacting law enforcement to obtain criminal sanctions against you, and suing you civilly for damages I have incurred as a result of your actions.

Again, you must IMMEDIATELY STOP [unwanted activities] and send me written confirmation that you will stop such activities. You risk incurring some very severe legal consequences if you fail to comply with this demand.

This letter acts as your final warning to discontinue this unwanted conduct before I pursue legal actions against you. At this time, I am not contacting the authorities or filing civil suit against you, as I hope we can resolve this matter without authoritative involvement. I am not under any circumstances, however, waiving any legal rights I have presently, or future legal remedies against you by sending you this letter. This order acts as ONE FINAL CHANCE for you to cease your illegal activities before I exercise my rights.

To ensure compliance with this letter, and to halt any legal action I may take against you, I require you to fill in and sign the attached form and mail it back to me within 10 days of your receipt of this letter. Failure to do so will act as evidence of your infringement upon my legal rights, and I will immediately seek legal avenues to remedy the situation.

I understand that [your full name] potentially has the right to pursue legal action against me relating to my engagement in these activities, but [he/she] will not pursue those rights in contemplation of my compliance with this written demand. I further understand that [your full name] has not waived [his/her] rights and may pursue legal remedies against me if I fail to abide by this agreement. I understand that this agreement is not specifically limited to the activities named herein. I will not engage in any activity now or in the future done for the purpose of [stalking/harassing] [your full name]. I furthermore agree not to engage in any activity, regardless of its official title, that is done in violation of [your full name]’s legal rights. If I fail to cease performing these activities, [your full name] may pursue legal action against me in accordance [his/her] legal rights. This agreement acts as a contract between [perpetrator’s name] and [your full name]. Forbearing enforcement of legally enforceable remedies is sufficient consideration to support this agreement. This agreement represents the entire agreement between the parties. Any statements made orally, written, or otherwise which are not contained herein shall have no impact on either parties’ rights or obligations elaborated in this agreement.

    Hi, my boyfriend called my work 153 times in one day. I was in a meeting so all the calls went to voicemail but someone noticed and gave my boss the call log. He also was upset that I ignored him and emailed a very polite note to my boss who is top level and told him he was concerned about not being able to reach me abc asked if he could please ask me to give him a call. I’m the HR person and someone who knew of my bf’s violent past told my manager who had no clue about my personal life and the co attorney sent him a cease and desist letter. I was not aware they were sending the letter and was texting him when a consultant told me he had just signed for it. I haven’t heard from him since. I love him and I don’t want my relationship to interfere with my work but they can’t dictate who I am in a relationship with, can they?

    here is my situation 6 months ago we had new neighbors move in after buying our second acre behind our first and having it surveyed we found that their privacy fence was 6 feet on our side and it interfered with them moving a second mobile home onto their property because of county code the long and short the cops have been called in excess of 6-8 times animal control for my dog barking ( he is inside pet ) we have a fenced yard and he only barks when they are outside we think they may be harassing him on potty breaks they have called the county for 3 trash bags being beside our porch and the latest visit from authorities was from DSS with outrageous claims of seeing me braek my sons arm LIE!! seeing me let my children play in trash LIE!! seeing my children in the trunk of my car LIE!! seeing me on my porch screaming I was going to kill myself LIE!! seeing excess traffic at my home inferring I was a drug dealer LIE!! I am on drugs LIE!! I had no running water LIE!! my house was filthy and I had multiple animal in my home I have 2 cats 2 dogs the investigator came in and said my home smelled like there where no animals running water and so many other outlandish accusation I cant recall them all the DSS officer talked with my children found the case to be unfounded at what point does this become harassment I mean they call any and everyone they can and its a waste of tax payers money and frankly this disrupts my home I have an autistic 9 year old and a 5 year old in my home and with all these visits from PD sanitations animal control and now DSS what can I do to make them stop? she has threatened me to fight got a trespass order on me which I asked for a mutual and the very next day was on my property putting up a fence on the property line #atmywitsend!

    I am learning so much today regarding my problem. I know that I am not insane and my employer is responsible for the issues in my life legally, professionally and morally. I have had enough of their insults, harassment, abuse,emotional abuse and bullying. Now I see when an employer wants you out they will go to any length to destroy you for no good reason and selfish reasons. I will chat with an attorney tomorrow and address the form letter Cease & Desist Letter.

    Does a cease and desist template letter sent via email carry any legal validity. Though I have not done anything defamatory or otherwise, my former employer, who knows i am fully aware of his illegal activity, sent me a letter via email telling me not to contact ANY of the employees, vendors or referring practitioners. Does this letter hold any legal validity?
